Arthur Lee Howlin walked out of jail on Tuesday night. His attorney, Michael Aed, said a DNA test revealed Howlin did not fire the gun used to kill 45-year-old Tina Banks and wound five others on April 27.
Howlin had been in jail for more than seven months. Aed said Howlin had told investigators he was outside his apartment complex near Fresno State with friends when someone told him there was a shooting at his apartment. He was giving aid to Banks when police arrived.
Aed said the gun used in the shooting was found and Howlin was ruled out as a suspect.
