Man faces murder charges after the death of his baby in 2017
BAKERSFIELD, Calif. (KBAK/KBFX) —
A Bakersfield man was arrested Saturday for second-degree murder in the death of his infant son in 2017.
Daniel Simental, 32, appeared in Kern County Superior Court this week on the murder charge, as well as a charge of assault on a child under 8 resulting in death.
His 3-and-a-half-month-old son, Peyton Simental, was taken by ambulance to Memorial Hospital on Oct. 6, 2017 and was found to be suffering from brain damage.
Daniel Simental told hospital staff and law enforcement that he was feeding Peyton a bottle and the baby started to choke and that was the cause of the injuries.
Peyton was flown to Los Angeles Children’s Hospital, where he later died from his injuries.
An autopsy revealed sustained subdural bruising and retinal hemorrhaging consistent with shaking and non-accidental trauma.
Simental is scheduled to appear back in court on Dec. 10.
